SMS Service Terms and Conditions

BIBS Danmark ApS, Business Registration No. 37218146, Hoegevej 19, 3400 Hilleroed, Denmark (hereinafter “we”, “our”, “us” or “BIBS”) offers an SMS/text messaging service (the “Service”). When you sign up with your mobile number to the Service, you consent to receive recurring SMS/text messages from or on behalf of BIBS through your wireless provider to the mobile number used when signing up (“Opt-in”), agree to be bound by these SMS Service Terms and Conditions (the “Terms”) and accept that your information will be used for SMS marketing. Therefore, please read the Terms carefully before signing up.

Service description and availability

By opting into the Service, you may receive updates and alerts about, e.g., campaigns and promotions, product news and pre-launches, discount codes and limited offers, as well as service-related messages (e.g., abandoned cart reminders). Text messages may be sent using an automatic telephone dialing system (ATDS) or other technology or type of system that may use an automated process for sending messages to the number provided by you. Message frequency varies, and we reserve the right to increase or decrease the number of messages that we may send to you at any time. Opting into the Service is completely voluntary, and your consent is not a condition of purchasing any goods from us.

The Service is currently limited to selected countries, and we reserve the right to expand or restrict availability at any time. In addition, we reserve the right to suspend access to the Service at any time and at our sole discretion.

Opt-in and opt-out

We collect consent to the Service through a two-step opt-in process. If you wish to opt-in to the Service, insert your mobile phone number in the signup form or pop up where such is available. Hereafter, you will receive a message containing a one-time code that you must use to confirm your subscription. If you no longer wish to receive SMS/text messages from BIBS, you can unsubscribe (“opt-out”) at any time by using one of the following approaches: 1) reply with the single keyword command STOP to the message received from BIBS, 2) click the unsubscribe link (where available), or 3) contact us at care@bibsworld.com. Hereafter, you'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you.

Costs and charges

We do not charge you for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

Change of short codes or telephone numbers related to the Service

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP requests, you send to a short code or telephone number we have changed may not be received, and we will not be responsible for honoring requests made in such messages.

Liability and disclaimers

You confirm that you are the owner or authorized user of the mobile number you provide. You are responsible for providing BIBS with a valid mobile number. You agree to notify us of any changes to your mobile number. If you get a new mobile number, your previous consent does not transfer automatically. You will need to opt in to the Service again with your new number, including completing the opt-in process described above.

You acknowledge that the wireless carriers supporting the Service are not liable for delayed or undelivered messages, and that BIBS is not responsible for issues related to your carrier's network or device.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Changes to the Terms and the Service

We reserve the right to update the Terms on an ongoing basis, including to ensure compliance with relevant laws and regulations, and to make sure they reflect our current business model. The Terms that apply to you are those you accept when you opt in to the Service. If we make material changes to the Service that affect the purpose or scope of your consent, we will notify you and, where required by applicable law, ask you to reconfirm your consent before the change applies to you.

Governing law

These Terms are governed by and construed in accordance with Danish law, without regard to conflict-of-law principles, and without prejudice to any mandatory consumer-protection provisions of the country in which you are habitually resident, which continue to apply where applicable.
